If a client owes money that they have agreed to pay, is rude to staff, dismissive, imperious, or tries to micromanage the attorney’s practice of law, the relationship is probably doomed to fail.

But until it does, attorneys have a professional obligation to acknowledge communication and address whatever problems may exist with their clients. If none of those things apply and an attorney still isn’t calling back, schedule an appointment through their support staff and try to restart the conversation. In New York, an insurance agent represents the insurer, not you. An insurance broker represents and works for you. As direct online sales increase, the role of a broker is often overlooked, and insureds are left to fend for themselves. If you bought a policy directly from an insurance company or its agent, you have to read it and make sure you got what you paid for.

If you signed a commission agreement with a broker who placed the wrong type of coverage for you, if your broker reviewed your operations and bought insufficient or incorrect coverage, or if you’ve paid a broker for risk management or consulting services, you may have a right to rely on your broker when your needs are not met.

Don’t mistake the pace of litigation with inattention or lack of care from your attorney. Probably. All attorneys have tricks to slow down or try and speed up a case, and if truth be told, if they worked all the time, most state court dockets would operate more like their federal counterparts.

Most cases settle, but most cases do not settle early. If your case is still working its way through discovery, your best bet is probably to keep working with your attorney as long as they remain committed to your case.
